1. Use of the Platform

You agree to use the Platform only for lawful purposes and in accordance with these Terms.

• Misuse of the Platform
• Fraudulent activity
• Disruptive or harmful behavior
• Violation of gym policies

2. Memberships & Payments

Memberships

• Memberships may be offered as recurring monthly subscriptions or one-time purchases.
• All recurring memberships continue until canceled.

Billing

• Payments are processed securely via Stripe.
• By subscribing, you authorize recurring billing where applicable.

Cancellation

• Memberships require 30 days’ notice for cancellation.
• Cancellation requests must be submitted through the Platform or by contacting us.

Refunds

Memberships are non-refundable unless otherwise required by law.

3. Merchandise Purchases

• Merchandise is sold via Shopify.
• Returns or exchanges are accepted within 30 days of purchase.
• Shopify’s privacy policy applies to those transactions.

4. Class Participation & Liability

Participation in martial arts training involves inherent risks.

• All participants must sign a Liability Waiver prior to attending classes.
• By using the Platform to book classes, you acknowledge these risks.
• The Company is not liable for injuries except where required by law.

5. User Accounts

You are responsible for:

• Maintaining the confidentiality of your account
• Ensuring your information is accurate
• All activity under your account

You may not:

• Share accounts
• Impersonate others

6. Leaderboards & Public Display

The Platform may display your name and class attendance metrics to other users in features such as leaderboards and check-in systems.

7. User Data & Profiles

You may provide contact information, emergency contact, and optional fitness-related data. You agree that information provided is accurate and you understand how it is used as outlined in our Privacy Policy.

8. Intellectual Property

All content, branding, and software on the Platform are owned by Branded Athletics, LLC.

• Copy, reproduce, or distribute content
• Reverse engineer any part of the Platform

9. Third-Party Services

We use third-party services including Stripe, Shopify, Firebase, and Resend or SendGrid. We are not responsible for third-party service interruptions or policies.

10. Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms.

11. Disclaimer of Warranties

The Platform is provided “as is” without warranties of any kind.

12. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect or incidental damages, loss of data or profits, or injuries resulting from training activities.

13. Governing Law

These Terms are governed by the laws of the State of Florida.
